VerifyNow does not certify that a business, workflow or customer is compliant with Luxembourg's CSSF requirements. A South African verification result can supply evidence for a separate compliance process. The regulated organisation and its advisers must determine the rules that apply to them.

South African scope

FIC Act customer-due-diligence duties attach to accountable institutions listed in Schedule 1. A foreign company does not become FICA-regulated merely because it verifies a South African person. Where the South African FIC Act applies, the accountable institution owns its RMCP, risk decision, enhanced measures, records and reporting. The official source is the Financial Intelligence Centre.

POPIA applies under its section 3 territorial test. It does not apply to every foreign organisation solely because a data subject is South African. A transfer from a South African responsible party to a foreign recipient must satisfy section 72. Use the Information Regulator for official privacy material.

What a VerifyNow result can establish

The selected service can return the identity, company, bank-account or screening fields described in its current catalogue and response. Record those fields as evidence. Do not convert them into a claim of CSSF approval, complete KYC, document authenticity, beneficial ownership, risk clearance or legal compliance.
